The unanimous Declaration of the united States of America, 1776 is --The Plan, The Design for what our nation is supposed to become. That Plan was to have a very well-informed population regarding how to control the very government they own. Government was to be very strictly limited —but powerful enough to do its Constitutionally authorized job. The Government's Practice
The Practice is what the government actually does. The Constitution of the United States of America is the Law over government. The government Practice, compared with the list of grievances in The Declaration, has simply continued along the 1776 British style of Tyranny --on steroids. The government practices no longer reflect the Constitutional limitations on government powers. The Public Perception The Constitution has become, in the minds of the people, The Perception as to what is happening in government. The Perception, by many people, is that the government is only doing what is necessary to maintain a peaceable society. That "peaceable" society has a rising crime rate; with the government officers violating nearly every constitutional limitation; exercising nearly every characteristic that The Declaration identified as tyranny. The unanimous Declaration of the united States of America is the foundation upon which The Constitution of the United States of America is built. Without The Declaration's authority, all contrary constitutional elements are void, —and must be repealed and not be exercised by government. The Declaration unifies the people who become the Sovereign body that creates and controls the government powers. The Constitution
The Constitution of the United States of America is the framework upon which every law must hang. Without constitutional authority, that law is void, —and must not be enforced by the government. Government action and laws once authorized by an older constitution, —must be physically repealed– so that lesser informed government officers do not violate the people's rights while enforcing laws that have become unconstitutional with the New Constitution. The Constitution does not replace The Declaration. They are intended to work together for securing the people's rights. The Law The Law is tyranny, despotism, and treason when The Constitution does not authorize its existence. The unanimous Declaration of the united States of America outlines a couple dozen political powers to help recognize a tyranny while it starts. The Constitution of the United States of America, Article 3, Section 3 defines the two types of treason. Type One is the active levying of war, which includes government officers violating The Constitution. Type Two can be active and or passive; in which a person actively gives aid and comfort to the nation's enemies, or passively by doing nothing to stop the constitutional violations by government officers. The law does not replace The Constitution. They are supposed to work together to help secure and protect the people's rights. Internal Checks & Balances
