Since it can be considered that the Sovereign Authority from which the government derives its just powers is also a branch of government; the following 4 are in their order of appearance and use are the Branches:
The Sovereign Authority grants to government its powers.
The Legislative is supposed to write and pass only those laws and acts of government that the Sovereign has authorized, usually by means of some constitution or charter.
The Executive is supposed to enforce only those laws and acts of government that the Sovereign has authorized, usually by means of some constitution or charter.
The Judicial, with respect to criminal cases, is supposed to try only those cases regarding the LAW and then the FACTS concerning only those laws and acts of government that the Sovereign has authorized, usually by means of some constitution or charter.
For any the last three branches to do anything that The Sovereign has not specifically, constitutionally authorized, The Declaration describes those actions as Tyranny & Despotism, and The Constitution, Article 3, Section 3 defines those actions as Treason
The Sovereign Authority that grants the powers to government. This is the body of Registered Voters; —specifically, the majority of the TOTAL number of registered voters.
The Local level, is the cities and towns.
The County level.
The State level.
The National Level.
Whether level or branch is the security of the governed people's rights. From Paragraph 2, The Declaration:
"We hold these truths to be self-evident, that all men are created equal, that they are endowed by their Creator with certain unalienable Rights, that among these are Life, Liberty and the pursuit of Happiness. —That to secure these rights, Governments are instituted among Men, deriving their just powers from the consent of the governed..."
